The investment processing

The process of investment planning requires the basic data on the land property to be used, such as its legal status, exact location, access to public road system, available media, building permits and the status of the property in the local Land Use Plan.

In the cases where the local Land Use Plan is not available, the investor should seek the formal decision specifying the conditions to build on the property.

Note: pursuant to the Act of March 27, 2003 about the planning and land use (Dziennik Ustaw [Journal of Laws] of 2003, No. 80, Item 717 with later amendments), the decision specifying the conditions to build on the property can only be issued if all of the following conditions are met:

at least one neighboring plot, accessible from the same public road, has buildings erected in the way that allows the conditions for the planned structures to be specified, considering the continuation of the building's function, parameters, features and land use planning, including the size and architectural form of the proposed structures and intensity of land use;
the plot is accessible from a public road;
the existing or planned media infrastructure is sufficient for the planned construction. This condition is considered to be fulfilled when the media infrastructure to be put in place has been subject to a formal agreement between the relevant authorities and the investor;
the land does not require a permit to be reclassified from farming or forestry land category to non-farming category, or it was subject to such a permit in keeping with land use plans that expired pursuant to Article 67 of the Act of July 7, 1944 about the land use planning;
the decision conforms to all other laws.

Obtaining the required permits and decisions and launching the investment project.

After the initial phase of the investment project has been completed and once the right of ownership of the property has been established, the investor should obtain proper permits or declare the intention to carry out the planned work. The specific route to be taken at this stage largely depends on the type of planned construction work. The construction can only commence after the decision granting the building permit (or demolition permit) has been issued.

Depending on the type of the planned construction work, environmental permits may be required as well. This normally happens when the planned investment project might have a significant impact on the environment. In such cases the environmental permits must be obtained before the building permit can be issued.

The investor is obligated to inform proper authorities of the date when construction is planned to begin. All construction work must be carried out and supervised by properly authorized personnel.

Completion of work and handing over of the property.

After the construction work has been completed, the structure needs to be formally accepted by relevant authorities. Where necessary, a license for use will be issued. The application for the license to use and the information about the completion of the construction work must be submitted to the County Building Inspector's Office. Environmental decision

The environmental decision is a formal document required in the case of projects that might have or will have an impact on the environment. In order for the positive decision to be issued the project has to be in agreement with the local Municipal Land Use Plan.

The types of projects that require the formal environmental decision are listed in the Regulation of the Council of Ministers of November 9, 2010 (Dziennik Ustaw [Journal of Laws] of 2010 No. 213, Item 1397, with later amendments).

The process of obtaining the environmental decision may involve, in some cases, producing a formal report assessing the project's impact on the environment. Such a report is required for all projects listed in Paragraph 2 of the Regulation. In the case of projects listed in Paragraph 3, the environmental report may or may not be required, subject to the decisions of Regional Environmental Protection Director and County Sanitary Inspector.

Required documents:

application for form;
formally authorized map of the area were the project is to be carried out, including the area where the invironmental impact is expected;
three copies of the project's data card (in the case of projects listed in Paragraph 3) and the electronic version thereof on a CD;
three copies of the environmental impact report for projects that will always have a negative impact on the environment (listed in Paragraph 2) and the electronic version thereof on a CD;
land registry entry for the area where the project will be carried out and for the area where the environmental impact is expected.
Fees:

a) PLN 205 – environmental decision fee
b) PLN 17 – power of attorney fee

Application processing time: each application is processed on the individual basis. In cases where no additional documents are required, typical processing time is 60 days.

Legal basis: the Act of October 3, 2008 concerning the disclosure of information pertaining to environmental protection, public participation in the protection of environment and environmental impact assessment ((Dziennik Ustaw [Journal of Laws] of 2013, Item 1235, with later amendments).
