The environmental decision is a formal document required in the case of projects that might have or will have an impact on the environment. In order for the positive decision to be issued the project has to be in agreement with the local Municipal Land Use Plan.
The types of projects that require the formal environmental decision are listed in the Regulation of the Council of Ministers of November 9, 2010 (Dziennik Ustaw [Journal of Laws] of 2010 No. 213, Item 1397, with later amendments).
The process of obtaining the environmental decision may involve, in some cases, producing a formal report assessing the project's impact on the environment.
